Frequently Asked Questions

Do I need a job offer for an EB-1 visa?

It depends on the category. EB-1A (extraordinary ability) does not require a job offer and allows you to self-petition. EB-1B and EB-1C generally require an employer sponsor.

What is a National Interest Waiver (NIW)?

A National Interest Waiver allows professionals with advanced degrees or exceptional ability to apply for a green card without a job offer if they can show their work benefits the United States significantly.

How does PERM labor certification work?

PERM is a process where an employer must demonstrate that no qualified U.S. workers are available for the offered job. It involves advertising the job and following strict Department of Labor requirements.

Can I open a business in the U.S. on an E-2 visa?

Yes. The E-2 visa allows nationals of certain treaty countries to invest in and direct the operations of a U.S. business. How long can I stay on an L-1 visa?

L-1A (executives and managers) can be granted for up to 7 years. L-1B (specialized knowledge employees) can be granted for up to 5 years.

Can my family join me if I have a business visa?

Yes. Most employment-based visas allow your spouse and unmarried children under 21 to apply for dependent visas. In many cases, your spouse may also be eligible to work in the U.S.
