Immigration Truths: Exposing Viral TikTok Myths

MYTH #1 - You Can Get a Green Card in Months

TikTok makes it seem like getting a green card is quick and easy sometimes claiming approvals in just a few months.   The reality is very different.

Most green card processes involve multiple stages: petition approval, visa availability, background checks, and final adjudication. For many categories, especially family-based and employment-based cases, wait times can range from several months to several years, depending on the category and country of origin.

Even in faster cases (like marriage-based green cards filed inside the U.S.), processing still requires:

  • A complete application package

  • Biometrics and background checks

  • An interview (in many cases)

There is no universal shortcut that bypasses these steps.

What’s often misleading online:

  • Claims of “no sponsor needed” without explaining limited exceptions (like certain self-petitions)

  • Promises of “guaranteed approval”

  • Confusion between temporary permits and permanent residency

👉 Immigration benefits follow a legal process — not social media timelines. Proper strategy matters more than speed.

MYTH #2 - You Don't Really Not Need a Lawyer Anymore.

Online advice often suggests that immigration cases can be handled entirely on your own using templates, AI tools, or step-by-step videos.   The truth is more nuanced.

While some straightforward applications (like renewals or simple filings) may be manageable, many cases require:

  • Eligibility analysis (choosing the correct category)

  • Legal strategy (timing, evidence, and filings)

  • Issue spotting (prior overstays, entries, or inadmissibility concerns)

Immigration forms are only one part of the process — the legal framework behind them is what determines success.

A small mistake — such as selecting the wrong category, missing evidence, or misinterpreting a question — can result in:

  • Requests for Evidence (RFEs)

  • Delays

  • Denials

What social media leaves out:

  • Immigration law changes frequently

  • Each case is fact-specific

  • Fixing errors after filing is often more difficult and expensive

The question isn’t just “Can I file this?” — it’s “Am I filing this the right way?”

MYTH #3 - You Can Safely Travel With Just Your ID or When Your Case is Pending.

There is growing confusion online about whether you can travel within the U.S. with a pending immigration case or without specific identification.

Here’s what you need to know:

Federal agencies, including TSA, require valid, approved identification to board domestic flights or pass through security checkpoints.

A REAL ID (a state-issued ID with a star) is now the standard for domestic air travel. If you do not have a REAL ID, you must use another acceptable document, such as:

  • A valid passport

  • A Permanent Resident Card (Green Card)

  • Trusted traveler cards (Global Entry, etc.)

Important:  Having a pending immigration application (like adjustment of status or a work permit) does not automatically grant travel privileges or replace valid ID requirements.

Traveling without proper documentation can result in:

  • Secondary inspection

  • Significant delays

  • In some cases, inability to board your flight

Always verify your documents before traveling — your immigration status and your travel ID are not the same thing.
